1. Acceptance of Terms

By accessing or using the Postbao application and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is owned and operated by TJK LLC ("we," "us," or "our"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Postbao provides a platform for content creators, entrepreneurs, streamers, and agencies to draft, schedule, and publish content across various connected third-party social media networks. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, including the availability of specific third-party network integrations.

3. Account Registration and Responsibilities

• Account Creation: You must provide accurate and complete information when creating an account.
• Security: You are responsible for safeguarding your account credentials and for all activities that occur under your account.
• Agency Use: If you are using Postbao on behalf of an agency, business, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

5. Subscription, Billing, and Cancellation

• Fees: Postbao is a subscription-based service. By selecting a paid plan, you agree to pay the fees associated with that plan.
• Billing Cycle: Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually).
• Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle. We do not provide refunds or credits for partial billing periods.

6. Intellectual Property

• Your Content: You retain all ownership rights to the content, images, and text you schedule and publish through Postbao. By using the Service, you grant us a limited, non-exclusive license to process, format, and transmit your content solely for the purpose of delivering it to your chosen social networks.
• Our Property: TJK LLC retains all rights, title, and interest in and to the Postbao platform, including its software, branding, logos, and user interface.

7. Third-Party Services and API Reliability

Postbao interacts directly with third-party social media platforms. We are not responsible for the availability, uptime, or functionality of these external platforms. If a third-party network changes its API, revokes our access, or experiences downtime, your ability to publish content may be temporarily or permanently impacted. We are not liable for any delays or failures in content publication caused by third-party networks.

8. Limitation of Liability

To the maximum extent permitted by law, TJK LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business reputation, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, completely secure, or error-free.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Texas.

11. Changes to Terms

We may update these Terms periodically. We will notify you of any material changes by posting the updated Terms on this page or via email. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms.
